The Philippine Department of Justice announced that the preliminary investigation into the case involving Chinese citizen Gong (also known as "Kelly"), suspected of kidnapping and causing the death of Chinese businessman Guo, has been completed. Sufficient evidence has been gathered to support prosecution, and it has been decided to charge him with two counts of "kidnapping for ransom resulting in death".
The National Prosecution Service (NPS) has reviewed all case materials and considers Gong to be the main perpetrator of this heinous crime, and will formally prosecute him under the Philippine Penal Code. The case has now entered the judicial process stage.
Additionally, the Department of Justice has clearly stated that Guo's son, Guo Xian, although summoned for investigation following the incident, has been officially cleared of any suspicion due to insufficient evidence and will not be prosecuted.
Furthermore, the Department of Justice recommends transferring three other individuals involved in the case—Yuan Hua, Yuan Qiang, and Li—to the Philippine National Police Anti-Cybercrime Group (PNP-ACG) for further investigation. The three are suspected of violating the Anti-Financial Account Fraud Act, and evidence collection is still ongoing.
Justice Minister Remulla stated that this resolution only signifies that the case has entered the litigation process, and all defendants still enjoy the right to due process and defense. He emphasized, "Our decision is based on evidence and law, unaffected by any external interference."
This case has attracted widespread attention and once again highlights the severity of transnational criminal activities within the Philippines. The case will next move to the court trial phase.
