目前国会中有14项涉及预测市场的法案正在审议中，其中10项仅在3月份就集中出现。参议院已于4月30日全票通过禁止议员及工作人员参与预测市场交易。然而金融倡导组织Better Markets首席运营官阿曼达·菲舍尔指出，最大的担忧仍集中在CFTC的监管本身。CFTC的规则提案已收到超过1500条评论，而该机构今年收到的其他提案中评论数量次高的仅9条。以体育为核心的增长驱动力却在机构配置逻辑中构成了一个深刻的悖论：体育合约占预测市场交易量的一半以上，但它们恰恰是法律上最具争议的产品。如果这些合约被禁，建立在体育交易巨量增长之上的机构兴趣是否还能维持，目前无人能给出答案。Elevate Government Affairs在提交给评论门户的意见中写道，针对职业运动员的目标攻击者并不会区分州监管下的博彩与预测市场合约——对他们来说，一笔投注无论在哪里发生，本质上都是一样的。
