A prominent lawyer who has argued dozens of cases before the U.S. Supreme Court was recently convicted on federal tax and fraud charges related to millions of dollars in poker winnings. A Maryland jury found SCOTUSblog co-founder and renowned Supreme Court litigator Thomas Goldstein guilty on 12 of the 16 charges he faced after a six-week trial, involving concealing gambling income and making false financial statements. Core charge: Earning 50 million a year, yet hiding 15 million in debt
The prosecution argued that Goldstein, by participating in high-risk poker games, earned about 50 million dollars in 2016 alone, approximately 22 million dollars of which came from Asia. He stopped paying taxes on his substantial gambling income from 2016 and misappropriated law firm funds to pay off gambling debts, also incorrectly deducting these debts as business expenses. The prosecution also accused him of concealing liabilities, including 15 million dollars in gambling debts, when applying for a mortgage to purchase a 2.6 million dollar property in 2021, thereby securing about 1.98 million dollars in loans. The Maryland federal prosecutor stated that this was a tax evasion scheme, choosing fraud over honesty, attempting to deceive American taxpayers while enjoying a luxurious lifestyle.
Defense's stance: Claimed "an oversight," but the jury was not convinced
Goldstein's defense team argued that the case stemmed from misunderstandings and mistakes, not deliberate fraud. The lawyer claimed that the tax filing errors were "unintentional" and not intended to provide false information or deceive the government. Goldstein himself testified, presenting an email from 2014 in which he instructed his staff to "always fully comply with regulations." The defense also argued that he concealed some gambling debts in his loan application out of consideration for his family. However, after two days of deliberation, the jury did not accept this argument.
Conviction: 12 charges upheld, facing maximum penalties
The jury found Goldstein guilty of one count of tax evasion, four counts of aiding and assisting in the preparation of false tax returns, four counts of willfully failing to file taxes on time, and three counts related to false statements in loan applications. Goldstein, who has appeared before the Supreme Court more than 40 times, retired from the practice area in 2023. He had also been part of the legal team representing Democratic presidential candidate Al Gore in the 2000 Supreme Court litigation. The exposure of this case stemmed from another gambler reporting a debt dating back to 2016 to the IRS. After the verdict was announced, actor Tobey Maguire, who had appeared in "Spider-Man," was also revealed to have testified. Goldstein's sentencing date has yet to be determined.
